TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

By accessing this website, enrolling in classes, purchasing products, participating in training, tournaments, seminars, events, or using any services provided by Central Kyokushin Karate (“CKK”), you agree to be legally bound by these Terms and Conditions.

If you do not agree, do not use this website or participate in CKK activities.

2. ELIGIBILITY AND MINOR PARTICIPATION

Participation in CKK programs requires:

  • Completion of required registration forms

  • Execution of a separate Liability Waiver and Assumption of Risk Agreement

  • Payment of applicable fees

Participants under 18 years of age must have all required documents signed by a parent or legal guardian. The parent or guardian accepts full responsibility for the minor’s participation and compliance with dojo policies.

3. INHERENT RISKS AND ASSUMPTION OF RISK

Kyokushin karate is a full-contact martial art involving significant physical contact and exertion. Activities may include striking, kicking, throwing, grappling, conditioning drills, use of training equipment, and partner drills.

Risks include, but are not limited to:

  • Bruises, cuts, strains, sprains

  • Broken bones, concussions

  • Joint injuries and dislocations

  • Serious bodily injury, permanent disability, or death

These risks may arise from ordinary negligence of instructors, staff, participants, or others.

By participating, you voluntarily assume all inherent risks associated with martial arts training and facility use.

4. SEPARATE LIABILITY WAIVER REQUIRED

Participation in physical training requires execution of a standalone Liability Waiver and Assumption of Risk Agreement.

To the extent permitted by law, the signed waiver governs claims related to physical participation and supersedes conflicting website language.

No individual may train without a completed waiver on file.

5. RELEASE OF LIABILITY

To the fullest extent permitted under Washington law, Central Kyokushin Karate, Ultimate Truth LLC, its owners, instructors, employees, staff, students, contractors, volunteers, and affiliates shall not be liable for any injury, loss, damage, or claim arising from:

  • Participation in training or events

  • Use of facilities or equipment

  • Acts of other participants

  • Website use

  • Digital training content

  • Ordinary negligence

Nothing herein releases liability for gross negligence or conduct prohibited by law.

6. MEDICAL RESPONSIBILITY

Participants are solely responsible for determining medical fitness for training.

CKK does not provide medical advice or diagnosis.

Participants agree to:

  • Disclose relevant medical conditions

  • Seek physician clearance when appropriate

  • Accept financial responsibility for emergency care

Emergency services may be contacted at the participant's expense if deemed necessary.

7. MEMBERSHIP, BILLING AND PAYMENT POLICIES

TUITION AND AUTO-BILLING

Memberships may be billed on a recurring basis according to selected plan terms. By enrolling, you authorize recurring charges unless canceled according to policy.

  • Monthly tuition is billed according to the selected membership plan.

  • Tuition payments are due on the scheduled billing date.

  • Late or failed payments may result in suspension of access to training.

CANCELLATIONS

Cancellation requests must be submitted in writing via email or designated system.

  • Cancellation becomes effective according to membership terms.

  • Tuition already processed is non-refundable.

  • Partial months are not prorated unless required by law.

  • Membership cancellations and suspensions require 15 days written notice.

TESTING AND EVENT FEES

Grading, tournament, seminar, and event fees are separate from tuition and are non-refundable once registration closes or materials are ordered.

FAILED PAYMENTS

CKK reserves the right to suspend participation for unpaid balances.

CHARGEBACKS

Initiating a chargeback without first attempting resolution directly with CKK may result in:

  • Immediate suspension

  • Recovery of fees and administrative costs

  • Collection action

8. FACILITY RULES AND SAFETY

All participants must:

  • Follow instructor safety guidelines

  • Use equipment appropriately

  • Immediately report injuries

  • Train within their physical limits

CKK reserves the right to modify schedules, instructors, or programs as needed.

9. SCHEDULE CHANGES AND FACILITY MODIFICATIONS

CKK reserves the right to:

  • Modify class schedules

  • Change instructors

  • Adjust curriculum

  • Close temporarily due to weather, maintenance, safety concerns, or events beyond reasonable control

Such changes do not entitle members to refunds.

10. CODE OF CONDUCT

CKK maintains a disciplined and respectful training environment consistent with Kyokushin principles.

CKK reserves the right to suspend or terminate membership without refund for:

  • Unsafe behavior

  • Disrespect toward instructors or students

  • Harassment or misconduct

  • Repeated rule violations

11. MERCHANDISE SALES

All merchandise sales are final unless defective.

Custom items (rank certificates, patches, special orders) are non-refundable.

CKK is not responsible for misuse of purchased equipment.

12. EQUIPMENT AND PERSONAL PROPERTY

Participants assume all risks related to use of training equipment and agree to follow instructor guidance at all times.

CKK is not responsible for lost, stolen, or damaged personal property brought to the dojo.

13. FORCE MAJEURE

CKK shall not be liable for interruption or delay in services due to events beyond reasonable control, including but not limited to:

  • Natural disasters

  • Government orders

  • Public health emergencies

  • Power outages

  • Fire or facility damage

15. INHERENT RISKS AND ASSUMPTION OF RISK

Martial arts training involves physical activity and inherent risk, including but not limited to:

  • Muscle strains or sprains

  • Bruising or impact injuries

  • Falls or collisions

  • Serious bodily injury

By participating, you acknowledge and voluntarily assume all risks associated with martial arts training.

To the fullest extent permitted by law, CKK and its parent organization Ultimate Truth LLC, its owern, instructors, staff, students, affiliates, and Ultimate Truth LLC are not liable for injuries, damages, or losses resulting from participation in training, events, or use of facilities.

16. INTELLECTUAL PROPERTY

All curriculum materials, logos, written content, videos, rank requirements, and branding are property of:

Central Kyokushin Karate (CKK)
Ultimate Truth LLC

Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

17. PRIVACY

Personal information collected through this website or during registration is used solely for operational, communication, and administrative purposes.

CKK does not sell or share personal information with third parties except as required by law or necessary for payment processing and operational functionality.

18. MEDIA RELEASE

Unless written notice is provided in advance, participants grant permission for photographs and videos taken during training or events to be used for promotional purposes in perpetuity.

19. ELECTRONIC COMMUNICATIONS CONSENT

By enrolling or submitting contact information, you consent to receive transactional communications related to:

  • Billing

  • Schedule updates

  • Policy changes

  • Registration confirmations

Marketing communications may be opted out of at any time.

20. NO GUARANTEES

CKK makes no guarantees regarding:

  • Rank advancement

  • Tournament outcomes

  • Fitness results

  • Skill progression

Progress depends on individual effort, attendance, and ability to learn and grow over time.

21. INDEMNIFICATION

Participants agree to indemnify and hold harmless CKK and Ultimate Truth LLC from claims arising from:

  • Their conduct

  • Violation of these Terms

  • Damage caused to persons or property

22. DISPUTE RESOLUTION AND VENUE

Any dispute arising from participation or website use shall first be addressed informally.

If unresolved, disputes shall be brought in the appropriate state or federal courts located in Washington State. Venue shall lie in the State of Washington.

The prevailing party may be entitled to reasonable attorney’s fees where permitted by law.

23. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

24. ENTIRE AGREEMENT AND NO WAIVER

These Terms constitute the entire agreement regarding website use and participation, separate from any signed waiver.

Failure to enforce any provision shall not constitute a waiver of future enforcement.

25. GOVERNING LAW

These Terms are governed by the laws of the State of Washington.

26. MODIFICATION OF TERMS

CKK may update these Terms and Conditions at any time. Continued use of services or participation in training constitutes acceptance of any changes.
